Please read these Terms and Conditions (“Terms”) carefully before using the AhaarScan platform (the “Service”) operated by Tantrija Enterprises (“Company”, “we”, “us”, or “our”). By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part, you may not access the Service.

1. Definitions

  • “Platform” — The AhaarScan website, web application, restaurant dashboard, and all related services.
  • “Restaurant Owner” / “User” — A registered business entity or individual who subscribes to the AhaarScan platform to manage their food business.
  • “Customer” / “Diner” — An end consumer who uses the platform (via QR code) to browse menus and place food orders.
  • “Subscription” — A recurring paid plan (Monthly or Yearly) that grants a Restaurant Owner access to the full features of the platform.
  • “Order” — A food order placed by a Customer through the platform at a participating restaurant.

2. Service Description

AhaarScan provides a QR-based direct ordering platform that enables restaurants to accept dine-in, takeaway, and delivery orders from customers without relying on third-party food aggregators. The platform includes:

  • QR code generation for table-based and general ordering
  • A customer-facing web application for menu browsing and order placement
  • A restaurant dashboard for order management, menu management, and analytics
  • Payment processing support (UPI, cash, card via third-party gateways)
  • Customer data capture and analytics for restaurant owners

AhaarScan is a software platform only. We are not a party to any transaction between a restaurant and its customers. We do not take responsibility for the quality, safety, legality, or delivery of any food ordered through the platform.

3. Accounts and Eligibility

  • You must be at least 18 years of age to register as a Restaurant Owner.
  • You must provide accurate, current, and complete information during registration.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately at info@ahaarscan.com if you suspect unauthorised access to your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription Plans and Billing

AhaarScan currently offers two subscription plans:

Monthly Plan: ₹399/month — billed every calendar month. Cancel anytime before the next billing date.

Yearly Plan: ₹2,999/year — billed annually. Saves ₹1,789 compared to 12 months of monthly billing.

  • All prices are inclusive of applicable taxes unless stated otherwise.
  • Subscriptions are renewed automatically at the end of each billing period unless cancelled.
  • You may cancel your subscription at any time; access continues until the end of the current paid period.
  • We reserve the right to change pricing with at least 30 days' notice to existing subscribers.
  • Promotional pricing and coupon codes are valid only for the periods stated at the time of offer and cannot be combined unless specified.

5. Payments and Refunds

Subscription payments are processed securely through Razorpay, a PCI-DSS compliant payment gateway. AhaarScan does not store your full card or bank account details.

Refund Policy:

  • Monthly subscriptions: No refunds are provided for partial months. You may cancel before the next renewal date to avoid future charges.
  • Yearly subscriptions: A pro-rated refund may be considered at our discretion if requested within 7 days of the billing date and where no significant use of the platform has occurred. Requests must be sent to info@ahaarscan.com.
  • Refunds are not available for subscriptions cancelled mid-term beyond the 7-day window, or for accounts terminated due to violations of these Terms.

For customer orders placed through the platform, any refunds or disputes are solely between the customer and the restaurant. AhaarScan does not mediate or process refunds for individual food orders.

6. Acceptable Use

You agree NOT to use the platform to:

  • Violate any applicable Indian or international law or regulation
  • Upload false, misleading, or fraudulent menu content or restaurant information
  • Engage in or facilitate spamming, phishing, or unsolicited communications
  • Attempt to reverse-engineer, hack, or disrupt the platform
  • Access another user's account without authorisation
  • Collect or harvest data from the platform through scraping or automated means
  • Impersonate any person or entity

Violation of these terms may result in immediate account suspension or termination without refund.

7. Intellectual Property

The AhaarScan name, logo, platform design, and all software are the intellectual property of Tantrija Enterprises and are protected under applicable Indian copyright and trademark laws. You may not copy, reproduce, modify, or distribute any part of the platform without our prior written consent.

You retain ownership of all content you upload to the platform (e.g., menu images, restaurant descriptions). By uploading content, you grant Tantrija Enterprises a non-exclusive, royalty-free licence to use, display, and reproduce that content solely for the purpose of operating the platform.

8. Data and Privacy

Your use of the platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Customer data captured through your restaurant's QR codes is owned by you (the restaurant owner).Tantrija Enterprises acts as a data processor on your behalf and will not use that data for its own marketing purposes.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Tantrija Enterprises shall not be liable for any:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunity
  • Damages arising from platform downtime, errors, or third-party service failures

Our total aggregate liability to you for any claims arising out of or related to these Terms shall not exceed the total subscription fees paid by you in the three (3) months immediately preceding the event giving rise to the claim.

The platform is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Termination

By you: You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period, after which your access will be suspended.

By us: We reserve the right to suspend or terminate your account immediately, with or without notice, if you breach these Terms, engage in fraudulent activity, or if we are required to do so by law.

Upon termination, your access to the platform ceases. You may request an export of your restaurant data within 30 days of termination; after this period, data may be deleted in accordance with our Privacy Policy.

11. Indemnification

You agree to indemnify, defend, and hold harmless Tantrija Enterprises and its officers, directors, employees, and agents from any claims, liabilities, damages, costs, or expenses (including legal fees) arising out of:

  • Your use of the platform in violation of these Terms
  • Your restaurant operations, including disputes with customers regarding food quality, delivery, or refunds
  • Any content you upload to the platform that infringes third-party rights

12. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in India.

Before initiating legal proceedings, both parties agree to attempt resolution through good-faith negotiation for a period of at least 30 days from the date of the written notice of dispute.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated to registered users by email at least 14 days before they take effect. Continued use of the platform after the effective date constitutes acceptance of the updated Terms. The current version of these Terms is always available at www.ahaarscan.com/terms-and-conditions.
